These Terms of Service ("Terms") govern your use of the Philosophi website at philosophi.app (the "Service"), operated by Philosophi ("we", "us", or "our"), a sole trader based in England, United Kingdom.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use Philosophi. By using the Service, you confirm that you are 18 or older. We do not knowingly allow access to users under 18 and will terminate any account found to belong to a minor.
2. Accounts
To access certain features you must create an account. You may register using an email address and password, or via a supported social login provider (such as Google). You are responsible for keeping your credentials secure and for all activity that occurs under your account.
You may not sell, transfer, or share your account with any other person. We reserve the right to suspend or terminate accounts that we reasonably believe have been transferred or are being used by more than one person.
3. Subscriptions and Payments
Philosophi offers optional paid subscription plans that unlock premium content and/or remove advertising. Subscriptions are available on a monthly or annual basis, at prices displayed at the time of purchase.
Payments are processed securely by Stripe and may be made by Visa, Mastercard, American Express, or Discover card. All prices are displayed in British pounds (GBP) unless otherwise stated.
By purchasing a subscription you authorise us to charge your selected payment method for the applicable fee on a recurring basis (monthly or annually, depending on your chosen plan) until you cancel.
You may cancel your subscription at any time from your account settings at philosophi.app/settings. Cancellation takes effect at the end of the current billing period; you will not be charged again after that date.
4. Free Trial
We may offer a free trial period for new subscribers. At the end of the free trial, your account will not be automatically charged. Access to premium features will be suspended until you choose to upgrade to a paid plan. We will remind you before your trial ends.
5. Refunds
All subscription purchases are for digital services and are generally non-refundable once access has been provided. If you believe you have been charged in error, please contact us at privacy@philosophi.app within 14 days of the charge and we will review your request.
If you are based in the United Kingdom or European Union, you may have a statutory right to cancel within 14 days of purchase under consumer protection law. However, by beginning to use premium features immediately after purchase, you acknowledge that the service has commenced and you may lose this cancellation right.
6. Acceptable Use
You agree not to use Philosophi to:
- Violate any applicable law or regulation
- Advertise, promote, or offer to sell goods or services to other users
- Sell, rent, or transfer your account to any third party
- Scrape, crawl, or systematically extract content from the Service without our written permission
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Transmit any malicious code, spam, or disruptive material
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Use the Service in any way that could damage, disable, or impair it
We reserve the right to suspend or terminate your account if you breach these rules, without notice or refund.
7. Content and Intellectual Property
All content on Philosophi — including philosophical texts, concept essays, images, design, and code — is owned by or licensed to us. You may not reproduce, distribute, or create derivative works from any content on the Service without our prior written consent.
Some philosophical texts reproduced on the Service are in the public domain. Where third-party rights exist, we have sought to obtain appropriate permissions. If you believe any content infringes your rights, please contact us at privacy@philosophi.app.
8. Third-Party Links and Services
The Service may contain links to third-party websites, including advertisements. We are not responsible for the content, privacy practices, or terms of any third-party sites. Visiting them is at your own risk.
We use third-party services to operate Philosophi, including Clerk (authentication), Stripe (payments), Vercel (hosting), Supabase (database), and Cloudflare (security). Your use of these services may be subject to their own terms and privacy policies.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
Content on Philosophi is for educational and informational purposes only. It does not constitute professional, academic, or philosophical advice.
10. Limitation of Liability
To the fullest extent permitted by law, our total liability to you for any claim arising from your use of the Service shall not exceed the total amount you paid us in the six (6) months preceding the event giving rise to the claim.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising from your use of or inability to use the Service.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
11. Dispute Resolution
If you have a dispute with us, please contact us first at privacy@philosophi.app. We will make a good-faith effort to resolve any issue informally within 30 days.
If a dispute cannot be resolved informally within 30 days, it shall be finally resolved by binding arbitration in London, England, conducted in English. This does not prevent either party from seeking urgent injunctive relief from a court of competent jurisdiction.
12. Governing Law
These Terms are governed by the laws of England and Wales. Subject to the arbitration clause above, both parties submit to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
